Terms of Service

These Terms of Service (“Terms”) govern your access to and use of CheckYourDM (the “Service”) operated by us at checkyourdm.com and app.checkyourdm.com.

By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. The Service

CheckYourDM helps Instagram creators automate replies, direct messages, and engagement workflows on their connected Instagram Business / Creator accounts using the official Instagram Graph API.

2. Eligibility

  • You must be at least 18 years old to use CheckYourDM.
  • You must own or have explicit authorization to manage the Instagram account you connect.
  • Your Instagram account must be a Business or Creator account (Meta’s API does not support Personal accounts).

3. Acceptable use — Meta Platform compliance

Because CheckYourDM operates on Meta’s platform, your usage MUST comply with Meta’s Platform Terms, Instagram’s Community Guidelines, and the Meta Developer Policies. Specifically, you agree NOT to:

  • Send unsolicited cold DMs to people who have not interacted with your account.
  • Mass-message followers — automation must be triggered by genuine recipient interaction (a comment, reply, or DM).
  • Send promotional, deceptive, fraudulent, or spam content.
  • Use engagement-bait CTAs (“comment YES”, “follow for follow”, “tag 5 friends”).
  • Impersonate Meta, Instagram, or other people / businesses.
  • Ask recipients for sensitive information (passwords, financial data, social security numbers).
  • Send content that is sexually explicit, hateful, violent, harassing, or illegal in any jurisdiction where your recipients live.
  • Attempt to circumvent the safety system (opt-out detection, frequency caps, content denylists) built into CheckYourDM.

We reserve the right, in our sole discretion, to suspend or terminate any account that violates these rules — and to report severe violations to Meta.

4. Recipient opt-out

You agree to respect every opt-out request. CheckYourDM automatically opts out recipients who send STOP / UNSUBSCRIBE keywords; you must not attempt to re-enable them without explicit re-consent from the recipient.

5. Your account

  • You are responsible for safeguarding your login credentials.
  • You are responsible for all activity that occurs under your account, including any automations you publish.
  • If you suspect unauthorized access, contact us immediately at [email protected].

6. Plans, billing, and refunds

6.1 Free plan

The Free plan is available at no cost subject to the usage limits published on our pricing page.

6.2 Paid plans

  • Paid plans (Pro, Business) renew automatically at the end of each billing period (monthly or yearly) at the price stated at checkout.
  • You can cancel auto-renewal at any time from Settings. Cancellation takes effect at the end of the current billing period — your plan benefits remain available until then.
  • Prices are listed in INR (₹) for Indian customers and USD ($) for international customers, billed in the same currency.
  • Applicable taxes (GST, VAT, etc.) may be added at checkout.

6.3 Refunds

  • Monthly plans are non-refundable once charged.
  • Yearly plans are eligible for a pro-rated refund within the first 14 days of the billing period.
  • To request a refund, email [email protected] within the eligibility window.
  • Refunds are not provided for accounts terminated for violation of these Terms.

7. Service availability

We aim for high availability but do not guarantee uninterrupted operation. CheckYourDM depends on third-party services (Meta, Supabase, Vercel, Resend, and others). Outages, maintenance, and Meta-imposed rate limits may affect the Service. We are not liable for missed automation deliveries caused by such third-party issues, recipient inactivity within Meta’s 24-hour messaging window, or recipient opt-outs.

8. Intellectual property

  • CheckYourDM, our logos, and our brand assets are our intellectual property. You may not use them without our written permission.
  • Content you create (automations, messages, replies) remains your property. You grant us a non-exclusive license to host, store, and transmit it solely to operate the Service for you.

9. Account termination

  • You may delete your account at any time from Settings or by emailing [email protected]. Deletion removes all your data within 30 days, except opt-out records (which we retain indefinitely to honor recipient consent) and minimal records required by law.
  • We may suspend or terminate your account at our discretion if you violate these Terms, abuse the Service, or harm recipients.
  • On termination, all automations stop firing immediately. Outstanding paid balances (if any) are refunded pro-rata only when termination is at our initiative and not for cause.

10. Disclaimers

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE.” WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS.

WE ARE NOT RESPONSIBLE FOR ANY ACTION META TAKES AGAINST YOUR INSTAGRAM ACCOUNT, INCLUDING WARNINGS, FEATURE LIMITS, OR ACCOUNT SUSPENSION. YOU ALONE ARE RESPONSIBLE FOR ENSURING YOUR USE OF CHECKYOURDM COMPLIES WITH META’S RULES.

11. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY TO YOU FOR ANY CLAIM ARISING FROM THE SERVICE IS LIMITED TO THE AMOUNT YOU PAID US IN THE 3 MONTHS BEFORE THE CLAIM AROSE. WE ARE NOT LIABLE FOR INDIRECT, INCIDENTAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES.

12. Indemnification

You agree to indemnify and hold CheckYourDM harmless from any claim, demand, or damages — including reasonable legal fees — arising from your use of the Service, your violation of these Terms, or your violation of any third-party right (including Meta’s Platform Terms).

13. Governing law

These Terms are governed by the laws of India. Any dispute will be resolved exclusively in the courts of Bengaluru, India, unless otherwise required by applicable consumer-protection law in your jurisdiction.

14. Changes to these Terms

We may update these Terms from time to time. The “Last updated” date reflects the most recent revision. For material changes, we will notify you by email or via a banner inside the Service at least 7 days before the change takes effect. Continued use of the Service after a change constitutes acceptance.
